Under Article 28 of Regulation No 593/2008, a contractual employment relationship formed before 17 December 2009 falls within that regulation only in so far as, on or after that date, the parties mutually agreed to vary it so substantially that it must be regarded as a new employment contract concluded on or after that date; that is for the referring court to determine.
