Article 18

Review

The Commission shall submit to the European Parliament and the Council, not later than three years after the date referred to in Article 17(1), a report on the application of this Directive and its impact on economic operators and consumers, in particular as regards the provisions on unsolicited communications, taking into account the international environment. For this purpose, the Commission may request information from the Member States, which shall be supplied without undue delay. Where appropriate, the Commission shall submit proposals to amend this Directive, taking account of the results of that report, any changes in the sector and any other proposal it may deem necessary in order to improve the effectiveness of this Directive.

The national court must, so far as possible, interpret domestic law in the light of the wording and purpose of Framework Decision 2002/584, taking into account the whole body of domestic law and applying the interpretative methods recognised by that law, so as to ensure that the Framework Decision is fully effective and achieves its objective.

Article 12 EC does not preclude legislation of an executing Member State under which its competent judicial authority must refuse to execute a European arrest warrant issued to enforce a custodial sentence against one of its own nationals, even though refusal for a national of another Member State who has a right of residence under Article 18(1) EC is subject to that person having lawfully resided continuously for five years in the executing Member State.
